We are occasionally requested to outline the process for assigning a builder’s offer of a condominium that has yet to be registered. If we have a client who would like to have his or her builder’s offer assigned to another buyer, we direct them to the builder’s on-site sales office to review the pertinent clauses in that offer to determine the assignment restrictions and fees.
The client should then also retain a lawyer to handle the documentation for this type of assignment. Retaining a lawyer who is familiar with this specific process is most beneficial for everyone involved.
